Probate

Losing a loved one can be a difficult time, and with the added pressure of becoming an executor or having to administer an estate, it can often become overwhelming.

Here at Taylor Brown, we have many years of experience, and are able to advise you as to the complexity of dealing with an estate.

We offer a range of services, including:

  • Applying for a grant of probate
  • Applying for letters of administration
  • Completing the necessary inheritance tax forms
  • Arranging for the sale or transfer of any property or assets
  • Contacting banks, and pension schemes
  • Preparing final estate accounts
  • Distributing the estate in accordance with the will
  • Deed of variation (where required)

Due to the complexity surrounding probate, we quote on an individual basis, with an indication of the costs being set out on our Fees page. For more information, please give us a call, send us an email, or visit the ‘Contact Us’ page and complete the online contact form. A team member will get back to you shortly to discuss your probate matter, and how we can help.

Key Milestones

In all cases:

  • You will have an experienced team member working on your matter.
  • We will take initial instructions, review the paperwork, and advise you how to proceed.
  • We make contact with the executors or administrators and beneficiaries.
  • We tell you the type of probate application you will require.
  • We complete a probate application and any HMRC forms required.
  • We make the application to the Probate Registry on your behalf.
  • We obtain the probate and send copies to the relevant parties.
  • We register the grant with the institutions and cash in and distribute all assets in the estate.

These give a general indication of some of the key stages in an Estate Administration, however you may wish to handle part of the Administration yourself. This will always be discussed with you.

How long will this take?

Non-taxable Estate

It will take between four and six weeks from your initial meeting  with us to obtain “probate” valuations of the deceased’s assets. The Probate Forms are then prepared and submitted to the Probate Registry and it takes approximately four to eight weeks for the grant to be issued.  It then takes about three to six months to cash in the assets and finalise matters.  Where a property and/or shares are involved this can take longer.

Taxable Estate

It will take between six and eight weeks from your initial meeting  with us to obtain “probate” valuations of the deceased’s assets. The Inheritance Tax Return then needs to be submitted to the Inland Revenue and Tax the due paid, and takes three to four weeks for the Inland Revenue to issue the Receipt.  In the meantime the other Probate Forms are submitted to the Probate Registry and it takes approximately four to eight weeks for the grant to be issued.  It then takes about six to twelve months to cash in the assets and finalise matters.  Where a property and/or shares are involved this can take longer.
